Auction Notice

All the intended bidders shall collect the Conditions of Sale from Centaline Commercial Auction Department or in the reception of the venue. Intended bidder(s) / purchaser(s) should rely on their own inspection and verification and should satisfy themselves on all matters, and where necessary, consult their own legal / professional advisers before they bid.

All the intended bidders shall conduct physical inspections of the properties that they wish to bid for. The Vendors give no warranty as to whether there exists any illegal structure / alternation in the properties. The Vendors would not give any warranty that the structures of the properties are in compliance with the Buildings Ordinance (Cap.123). The bidder(s) / purchaser(s) shall not raise any requisition regarding illegal structure / alternation nor refuse to complete the purchase on similar grounds.

Intended bidders should rely on their own inspection, measurement and verification and should satisfy themselves as to the accuracy of the particulars contained herein which are provided by Centaline Commercial Auction Department for information only. Our Company has not taken any step to verify whether the information reflects the actual status of the property. No warranty for accuracy is given or implied by the owners or us. Description, measurements, dimension, usage, areas, scale and data of the property set forth herein or provided in other situations are for general guidance only, such information is not warranted or guaranteed to be complete or correct. Interested parties should seek independent legal and/or professional advice regarding the information provided by our company (includes but not limited to the floor area, usage), client’s intended use, the legality of cockloft or mezzanine floor or building structure.

Our Company advises the interested parties to obtain and read the sales brochures / floor plans / price lists before they make a purchase decision and make enquiries directly with the banks and finance companies or the vendor (if financing schemes are provided by the vendor).

There is no standardised or commonly adopted definition of any description of floor area in the market for non-residential properties.

If the permitted use stated on the relevant occupation permit is provided, such information relates to the permitted use at the date of the issuance of the occupation permit only. In the case where no occupation permit is issued, the permitted use cannot be verified by our company. Besides, the Government Grant and/or the Deed of Mutual Covenant may contain provisions restricting the use for specific purpose(s).

If the property has a cockloft or mezzanine floor but the relevant occupation permit does not reveal the same, the legality of the cockloft or mezzanine floor cannot be verified by our company. If there are unauthorised building works, the risks include but not limited to: the Government’s exercising its right of re-entry, safety problems, closure and bank’s refusal to finance the purchase.

Provided that General and Special Conditions are printed in English and Chinese, and in case any difference or dispute shall arise as to the construction thereof, only the English version shall apply and prevail.

Subject to a reserve price, the highest approved bidder being so allowed by the Auctioneer shall be the Purchaser thereof. The Vendor reserves the right to withdraw the sale of the Property any time before the same is actually sold or the reserve price is reached without declaring the reserve price.

The Purchaser shall immediately on fall of the hammer pay to Vendor a deposit equivalent to 10% of the purchasing price and Centaline Property Agency Limited a commission equivalent to 1% of the purchasing price (subject to minimum charge of HK$10,000.00) in cash or by cashier order or cheque and sign the Memorandum of Agreement in the form annexed hereto to complete the purchase according to the General Conditions of Sale and Special Conditions of Sale.

The Purchaser shall provide document for signing the Memorandum of Agreement. If buying in the name of:
Personal : I.D. Card / Passport
Company : A valid Business Registration, a minutes of Directors’ meeting for consent such purchase, Company Chop and I.D. Card / Passport of the Purchaser.

In the Public Auction, the bidders shall be deemed to have fully understood and accepted the notice of above-mentioned and the General and Special Conditions of Sale (Bidders shall have no right to request amending any terms / clauses of the General and Special Conditions of Sale).

All the prospective bidders are requested to note that Centaline Commercial Auction Department will only answer questions of a general nature concerning the properties to be auctioned and will not provide legal or other advice in respect of the Conditions of Sale or statutory provisions relating to the properties.

It is hereby specifically declared by Centaline Commercial Auction Department that any statement, whether oral or written, made and any action taken by us in response to any enquiry made by a prospective bidder shall be for guidance and reference purposes only. Any statement shall not be deemed to form part of this Notice and Announcement to Bidders / Purchasers and any such statement or action shall not be deemed to amplify, alter, negate, waive or otherwise vary any of the terms or conditions as are set out in this Notice and Announcement to Bidders / Purchasers or the General and Special Conditions of Sale.
